The Question
I have moved into my first home and I love it. However, I do have an issue with next door. They have two dogs, which are constantly barking while their owners are out at work. I don’t feel I can approach my neighbours about it. Any legal advice?
Mark’s Answer
Always try to approach your neighbours first, to try and agree a compromise. They may not realise that there is an issue, until you point it out to them.
If you are not comfortable speaking to them, then a constructive written note to them is an alternative.
If that does not work, then keep a diary of the issues, and consider contacting your Local Authority explaining your neighbours are causing a statutory nuisance.
The Local Authority should then investigate. Mediation may be suggested. The Council has the power to intervene and can ultimately issue a Noise Abatement Notice and then prosecute.
